20 Clean 02 Dec 2014 A Supreme Court Bench headed by President Pranab Mukherjee quashed a petition by the Assam High Court (CH) on Wednesday, December 2. The Bench had issued notice saying the Constitution Act, 1999, which provides for separate reservation in the National Assembly, was unconstitutional since it was "arbitrary" and was contrary to Section 44 of the Constitution. The Bench had said the Section 44 provision was invalid because it was aimed "at the elimination of caste by discrimination on grounds of backwardness." In our e-book, President Pranab Mukherjee discusses the decision and explains what is really behind it. What did the High Court decide? Did the SC decide it was unconstitutional? Who made the judgment? Why did the SC go against the Constitution? The question becomes "If this is all over, what is the purpose of all these court decisions?" To find out, we sat down with the President and Chief Justice to get his take on the case. Read President Mukherjee's statement below... What was the reason for making the order? The SC order was to bring the whole debate in the country in a positive manner. For example, it was to put the decision back on the table and to show the way out of what I view to be unfair treatment. But why does the SC order require a high court judgment? It is due to the fact that at present, the court is in a state where it has to entertain only a few cases a day. The government has to consider how to implement what is coming out of it. So there is a real need if there is an issue or controversy, for the SC to go against the majority consensus. Will this allow for resolution of the issue if there is no such consensus? In the opinion of the SC, this court has a role to play in resolving any controversy on the ground of discrimination. Does the SC order solve the issue? At present, only six out of every 10 issues of SC decide can be put before it which means that only 6 out of 10 SC decisions can be taken in a country or a nation. We have to take away the power that there is now to decide, it is not right for this court to have power to be the judge that makes a decision. Therefore, I am very pleased with my order and I believe the judgment takes us in the right direction. What happens now? Will this have the desired effect?
